Terms of Use for ePet

1. Acceptance of Terms

By downloading, installing, accessing, or using the ePet mobile application ("App") or any related services, you agree to be bound by these Terms of Use ("Terms"), which constitute a binding agreement between you and Kimsola LLC ("we," "us," "our"). If you do not agree with these Terms, do not use the App.

These Terms apply to all users, including casual users, registered users, and those who access the App via third-party platforms or services.

2. App Purpose and Disclaimer

ePet is for entertainment purposes only. The App provides simulated "translations" of cat and dog sounds using pattern recognition and user interaction. These translations are not scientifically verified and should not be interpreted as actual communication from animals.

The App is not a veterinary tool and is not intended for use in diagnosing or treating animal behavior or health issues. Always consult a qualified veterinarian or animal behaviorist for any concerns regarding your pet's well-being.

3. User Eligibility

You must be:

• At least 13 years old (or older if required by your jurisdiction)
• Legally capable of entering a binding agreement
• Not barred from using the App under any applicable laws

If you are under 18, you must have parental or legal guardian permission to use the App.

4. License and Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial use, in accordance with these Terms.

You agree NOT to:

• Reverse-engineer, decompile, or tamper with the App
• Use the App for illegal or abusive purposes
• Harvest or collect data from other users
• Bypass security or access controls
• Upload malware or viruses
• Sell, rent, or sublicense the App

Violation of these restrictions may result in termination of your access and potential legal action.

5. User Content

You may be able to submit or generate content in the App (e.g., pet profiles, saved translations, audio clips). You retain ownership of your content but grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, distribute, and display such content solely to operate and improve the App.

You are solely responsible for the legality, reliability, and appropriateness of your content. You may not upload or share any content that is offensive, illegal, or infringes on the rights of others.

6. In-App Purchases

Some features of ePet may be available through in-app purchases or subscriptions. All purchases are final and governed by the payment platform's terms (e.g., Apple App Store, Google Play).

We do not offer refunds except where required by law. Subscriptions may automatically renew unless cancelled.

7. Intellectual Property

All content in the App—including but not limited to software, designs, logos, text, graphics, and audio algorithms—is the property of Kimsola LLC or its licensors, and protected by copyright, trademark, and other laws.

You may not use our branding, assets, or materials without prior written consent.

8. Third-Party Services

The App may contain links or integrate with third-party services (e.g., AdMob, analytics tools). We are not responsible for the content, privacy practices, or reliability of those services.

9. Termination

We may suspend or terminate your access to the App at any time, without notice or liability, if we believe you have violated these Terms or applicable laws.

Upon termination:

• Your license will be revoked
• Your right to access the App ends
• Certain provisions of these Terms will survive (e.g., liability disclaimers, intellectual property clauses)

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee:

• That the app will function uninterrupted or error-free
• The accuracy or reliability of translations
• That the app will meet your expectations or specific use cases

Use of the App is at your sole risk. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Kimsola LLC and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on the App or through other reasonable means. Your continued use of the App after such modifications constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
